  • 1.  Is this a Gift in Kind

    Posted 07-31-2023 10:34 AM

Our football coach while he was recruiting 8 stayed nights at his parents home, instead of staying at a hotel. He is now asking if his parents could give those 8 nights to the University as a Gift in Kind?

    Thanks

    Liz

No. That's partial interest. Even if his parents usually charge their own kid to stay at their home.

    John,

What if other coaching staff stayed at the home? Unrelated to the folks that own the home.

    Thanks

It's still partial interest. No one is being given ownership of anything. Only the use of the house by the owners.  See IRS Publication 526.

The overnight lodging is not a GIK, as John said. However, if the staff were served meals, those could be a GIK.

Even with my tendency to want to make reasonable allowances for in kind support, I honestly wouldn't be all that inclined to attempt calculating recognition value in this scenario. If there was any intent for charitable support on the part of the parents then the coach should have brought up this idea of "in kind" credit in the planning process for the trip to determine if it was even a possibility and not bring this up as an afterthought...

    IMHO, of course.
