  • 1.  Quid Pro Quo Question

    Posted 02-26-2024 03:35 PM

Our Day of Giving is coming up in April. Our development would like to have a challenge match for an hour. The President of the university would be providing $1,000 match. They would like to set it up something like this. If you make match the president's gift of a $1,000 will will have the opportunity to be invited to an exclusive event with the President.

I have no idea the cost of the event or if there will be food.

We can send out corrected receipts once we know what the event is about, but I'm just not sure we can do this or if it is a gift.

    Thanks for your feedback

    Liz

Sadly this will result in a QPQ. The problem is that the value will likely NEGATE the deductibility AND countability. Most of this giving day gifts are nominal - especially when coming from students.

Please don't let them do this. If they move forward you will have to tell donors their gift may - or may not - be tax-deductible.

    John,

The donors have to be given at least $1,000, so this is not available to everyone. This is why I'm wondering if we can do this at all, because not everyone has the same opportunity.

Ah - I thought the total match was $1,000.

In that case you can get away with issuing full receipts as long as they keep the FMV of the event below $20.

Otherwise you have to tell donors that not all of their donation is deductible unless they refuse it up front - and you should not issue a receipt until you know the FMV.

However, donors using DAFs or private foundations are not eligible to be invited no matter what.
