    Me again!

     

    Our team wants to auction 100 bottles of whiskey on an online platform (onecause) and distribute the bottles to winners in person.  Legal? Does anyone have experience doing something similar?  Or deciding not to do something similar?

    You'll need to look for legal counsel.

    There likely are state laws (yours and others) addressing online liquor sales, including licensing requirements.

    I also know some states have regulations regarding the shipping of alcohol across state lines. For instance, per North Carolina ABC Law (chapter 18B), "shipping or receiving any malt beverages or liquor to residents without a valid wholesaler's permit is illegal."

    I forgot to mention that your auction function will need some method for validating that the bidders are of legal age to acquire alcohol (assuming it's legal to sell online).

    I would agree with John that I would ask counsel on this as liquor laws vary widely at the state and local levels. I know here in Indiana this would be illegal. What you typically see here is liquor raffles conducted by stores that have a license to sell, and what is raffled is the "right" to buy the bottle at list price – they cannot be given away.

     

    The perspective I wanted to add is you may want to consider the possible implications of conducting this activity on your liability insurance. Should the organization come under scrutiny for distributing large amounts of alcohol this may have an impact on premiums or require an additional rider to cover the event.
