  • 1.  Car Raffle + Online Ticket Sales

    Hello-

     

    Our university received a car as part of an estate. We would like to raffle the car, opening the raffle in June and drawing the winner in September. The goal is to sell tickets in-person in two states and offer them online to our alumni.  To offer the tickets via online sales, we would have to comply with online gaming laws of each state, correct? Even if the tickets are offered by email solicitation? Meaning, we are beholden to the laws of the states in which our alumni reside and receive the solicitation?

     

    Has anyone had experience with this particular issue/have you conducted a successful online car raffle and could you offer advice?

    Please seek advice from Counsel.  As you know, none of the income will be deductible.  But not only will you have Vermont Gaming statutes to consider, but those in all states where your participants reside.

    And that is on top of Federal laws and IRS requirements.  It does not matter whether the vehicle was donated - you will need to regard its full value in reporting.

    Reed, in addition to John's sound advice, it's worth noting that it seems impossible to meet the compliance requirements to sell tickets online in NY, so if is an important state to you in terms of alumni, that might be a decisive factor on its in own in choosing whether to go forward. Even aside from how strict and unworkable NY's requirements appear to be, there isn't yet an application ready to fill out, and you need to demonstrate your system to the commission more than 60 days before ticket sales start, which doesn't seem to fit your timeline.
