  • 1.  Threshold for requiring a deed of gift/gift agreement

    Posted 06-18-2024 02:04 PM

    Hi all,

Repackaging this question but still particularly interested in the context of in-kind gifts. What dollar threshold do you require for an in-kind gift to be accompanied by a gift agreement that includes deed of gift language? Is it still $5,000 to coincide with the 8283 requirements?

    Thanks again in advance.

John, as with non-GIKs, I do not see "deed of gift" language used that much anymore. The standard gift agreement describing what is being conveyed is normally sufficient.

I usually see the word deed used only with real property donations. And with vehicles, the word title or title transfer.

But if I had to use "deed of gift" for in-kind donations I would stick to $5,000+
