  • 1.  Potential Gift of Motorized Agricultural Equipment

    We have a donor who has expressed interest in possibly donating a tractor for related use.

    I've set up unrelated use vehicle donations through partner vehicle donation programs before, and it has worked quite well, however, I'm unsure if a tractor is considered a vehicle or a regular gift in kind. It is motored and can be driven on highways between fields (not in our case), but it is not a "motor vehicle manufactured primarily for use on public streets, roads, and highways; a boat; or an airplane" as it is defined in IRS Publication 4302/4303.

    I would love to talk to anyone who has accepted gifts in kind of motorized agricultural equipment - about how it was booked and any additional logistics you might have needed to do in-house.

    Those publications are no longer in current circulation. They were last published in 2015. However, I do not believe back then that the IRS would have considered a tractor as a "vehicle" for those purposes.

    Instead, I would focus on the requirements for IRS forms 8283 and 8282. And, I suspect that for your donor to claim a deduction, they will need an appraisal (if the value is estimated to be over $5,000). I would not tell them that's a requirement, but rather, they need to seek independent tax advice.

    Once the donation is complete, I would execute your portion of the 8283 and issue a standard property receipt (description without value).

    By the way, while those publications haven't been updated since 2015, Form 1098-C (receipt for motor vehicles, boats, and airplanes) has been updated this year. That said, I am confident that your piece of equipment does not qualify as a "motor vehicle." Nonetheless, if your donor requests a 1099-C at tax time, there is no harm in completing that form. So, I wanted you to know that there is a current version!
