We will be holding our annual charity gala soon. We have a donor who committed a gift certificate to a local restaurant for $800. He would like to "just settle up" with the restaurant following the purchaser's dinner. Can we issue a gift-in-kind to him following proof of payment to the restaurant? This is a new donor and I feel this is not a best practice. I appreciate feedback I can share with the DOs.

    Thanks for your time!

Are they donating a gift certificate for $800? Or paying for a dinner after-the-fact for up to $800? If the latter, I don't see any other way of handling it. You would need a copy of the receipt and proof of payment (so the receipt can be issued in that name). But the receipt will still only reflect paying for the dinner - with no mention of value.

The receipt should also reflect that this was donated for a charity auction and not for a related purpose.

Thank you, John. You are correct in that it is the later. Their original statement was that they would give us the certificate. Now they are requesting to make a direct payment to the restaurant. (I was thinking that because we never received something directly that we could not issue a GIK even with the receipt.) I appreciate your advice.

We will request a receipt and proof of payment. Can you advise what would suffice as proof of payment? The dinner is being paid for by 2 different donors. Will we need to advise them to both make payment to the restaurant, or can one pay and show proof of reimbursement from the second donor? (Sure seems easier if they would just  purchase the gift certificate.) ;)

The proof - for both - would be either a credit card receipt reflecting the name on the card(s), or a copy of the canceled check.
