  • 1.  Gift in Kind?

    Good morning!

We are celebrating our school's 50th anniversary this weekend - yay! One of our major donors unfortunately can't attend because of a scheduling conflict, but he'd previously made a lodging reservation at a local luxury inn. He gifted the stay at the inn to us so we could raffle it off to a random winner (we pulled the winner from the list of people who'd registered for the anniversary weekend).

Can I provide a gift in kind receipt for this donor? We weren't initially planning to offer a raffle - the only reason we did is because he offered the room to us at the last minute.

In general, a gift of a hotel room by someone other than the hotel is a GIK and can be receipted. The issue is whether you should accept this GIK, given the circumstances. Raffles are a pain, legally speaking, and it's not clear how raffling off the room is serving your charitable purpose in any way. It's a random upgrade for some participant, with your org as a conduit to facilitate a tax deduction for the donor. Couldn't the donor cancel their reservation and donate the money directly to you instead? It would certainly have more impact that way.
