    Hello. We have a supporter whose great grandfather was a historical figure. She would like to gift us artwork, books, paintings etc. We may be tasked with loaning out some of the items to musues or tours. We are also in the process of building the appropriate climate controlled room requirements (for other things we have). She lives abroad and is not requesting a tax receipt. Any suggestions on language to use on a  gift in kind gift agreement or MOU would be greatly appreciated.

    I would be more comfortable letting Counsel draw up the MOU. It should, however, itemize each separate piece donated. It should also address your commitment to building the appropriate climate-controlled space.

    Whether you decide to loan any of the items to other organizations is your call as you will be the owner. If the donor requires you to loan out any pieces, then they really do not belong to you! So I would ensure the MOU addresses that!
