  • 1.  Fund Contact/Steward -- Implications for Limiting/Cutting Contact?

    Hi, All!

    We had a donor endow a scholarship. They requested their (adult) child be the steward of their fund, and then the donor passed away. This person has caused some trouble with our college and we have submitted a cease & desist, and barred them from our campus. Our office would like to mark them no contact of any kind to ensure that there is no further escalation. Someone pointed out that this could cause conflict with the gift agreement - which directs us to send this person endowment reports.
    Has anybody experienced this, and how did you handle this? Are the endowment reports stewardship that could be stopped due to this situation, or are they an obligation?
    Understanding that we may have to reach out to this person for amendments, does anybody have suggestions about how to navigate removing this person as the steward, if we are able?

    Hillary, I am afraid that as the gift agreement is a legal document, you will need your attorney to rule on whether the cessation of delivery of the annual report would violate the terms of the agreement.
