  • 1.  Donor Request On A Donation

    We have a situation where that donor has made a request that we buy a couple of books (that he has chosen) using part of the money he is donating. He wants the 2 books given to a first year student and a second year student. Outside of the logistics of how do you choose a first year and second year student to receive 1 of the 2 books. Is this still a gift? Something about it just does not feel right to me. Are there questions I should be asking that I have not thought of?

    I should state that it appears as if we get the donation regardless of if we honor the request or not. Then to possibly complicate the matter further, at least in my opinion, this is an IRA Rollover. So if this is not completely a charitable gift, it would appear to me, that we cannot accept the IRA Rollover. If it matters, this also is not something that we normally be doing either.

    our last sentence about this not being something you would normally do is key.  In my mind, then, this would not be a gift.  I'd suggest that the donor use their money to purchase the books and award them separately (from you).

    As for the IRA question, if the payment is a QCD, then you are correct.  Those funds can only be used for charitable purposes - not giving gifts to a few select students.  If this is an RMD, the donor can use those funds in any way they wish - including buying books for a few select students.  Only that portion of the distribution would not count as a gift.
