  • 1.  Donor paid for 10 tickets but only used one

    Hello All,

     

    I have a situation where a donor paid for a table of 10 but only used 1 ticket.  Do I still include the FMV as if they used the whole table or do the FMV for only 1 ticket?  Thanks!

    By the way, the donor wants to turn the 9 unused tickets into an event contribution.

    The strict answer here is that you can't convert the tickets into a donation. At the time of purchase, the donor did not have a charitable intent as regards the non-gift portion of the ticket. They bargained for a set of services that you stood ready to provide, but which they did not use. In general, benefits must be declined at the time of donation to preserve the tax deductibility of the full contribution.

    It does not matter how many were used. They still received the benefit of all ten. They could have declined the other 9 - or possibly donated the others in advance as a GIK. But after the fact that does not work.
