The other thing I realized after I pressed send was that knowing the rules, even if the individual tried to get the DAF to buy the table, you would not have allowed it!

Sure thing, end of day brain. I think that he just recommended a grant for the university- and was letting us know he will not be attending this year. I get what you are saying that he would not have any thing to turn back in. Thanks so much for the speedy reply. HN

So, the DAF would never allow the use of their funds to purchase a table. So the case you describe could never exist. The individual must certify that no benefits will be given.
However, the individual could request a DAF grant refusing the table and all benefits in advance. But there would not be anything for the individual to turn in.

Hi John, I'm sure it's on the site somewhere, but if a donor requests money from his DAF for a gala, but cannot attend and gives the table back to the university. He is not incurring any incidental benefits. We would not send him a tax receipt, but just a thank you acknowledgement for the gift. Is this ok?
Thank you!

I cannot recall if I have shared this link before - but it's a good one! And it addresses this topic and several others. See the events section for this issue:

The IRS prohibits this! It is called bifurcation and disallowed by the IRS.

John,
Why would this be fraud, if the donation portion is sent by the DAF and the FMV is paid separately?

Sure there is an issue - you would be knowingly violating IRS regulations. It's a form of tax fraud. Ask your Counsel if that's something you should be doing.

Thank you, John. Is there any liability the charitable organization for accepting the gifts or is it truly a donor issue? In this scenario, the donor committed to a $25K event sponsorship that grants him a table for 10. He sent two payments from his DAF, one for $23,250 and one for $1,750 (value of goods and services).

Share with them the news that you are helping them avoid violating IRS rules that could result in fines or penalties. They could also cause fines and penalties to their DAF provider, which could cause the provider to take legal action against them for violating their terms and agreements.

This year we have been actively working towards not accepting DAF payments or bifurcated payments for our two signature events. We receive a lot of resistance from donors and at times their legal teams regarding this. What is the best way to navigate these conversations without discuraging donor participation of these key initiatives?
