  • 1.  Acknowledgment for Data License 'gift'

    Hi,

    A donor is giving us a license to use a data collection for a year. I know this can't be counted as a gift, but we'd like to acknowledge the donor.

    At what point would a note of thanks cross into fraudulent GIK receipt territory?

    It's not fraudulent to say thank you. I would avoid the typical language that you do not provide good or services in exchange for the gift.

    It would cross that line if you mentioned tax-deductibility or included the IRS "no goods or services" language.

    I always play these things very safely to ensure there's no confusion. My acknowledgement would still not include any valuation information. It would consist of something like, "While such a donation is not eligible as a charitable donation from an IRS perspective, we recognize that your generosity will help further the mission of our organization."
