  • 1.  Trustee U/A vs Trustee on check

    We received a check from a donor that included the name of the trustee as well as the "Trustee U/A" listed in the account holder section. The person who signed the check is listed as the Trustee. The person we mailed the appeal to is our alumna (quite elderly) and is listed as the Trustee U/A. I am making the assumption this gift was directed to be sent to us by the Trustee U/A. Who should receive the tax receipt in this situation - the Trustee or the Trustee U/A?

    U/A stands for "Under Agreement."

    The trust itself might be the donor. But it depends on how the trust was formed.

    Did the check reference anything like "The John Taylor Charitable Trust?" And then listed the trustees? If so, you may need to create a trust record. Otherwise, it would be appropriate to record the gift on the original donor record.

    In the account holder section of the check, the very first line notes: The Amnd and Rstd [Trustee U/A Last Name] Dec Of Trust. Then it lists the Trustee on the next line, and the Trustee U/A on the next line after that. The address is the home address for the Trustee, not the Trustee U/A (our alumna).

    I can't suggest much more without calling the bank or the trustee (signatory). Have you contacted either of them?

    Absent direct confirmation, I'd be inclined to create a record for the trust and issue a receipt in that name. I would also give soft-credit to the original donor.

    I'd then mail the receipt to the address indicated. They will contact you if the trustee does not agree with your handling.
