  • 1.  Royalties as donation?

    Hello, 

    I've read through the discussions on royalties and 1099's but want to get input from others on this specific contract we have been provided. Is this a gift? If so, who is the donor? Do any questions need to be asked of the publisher or author (a faculty of our university)

    Sure, it's a gift (unless it is a mandated court settlement). The only problem is that you can't really book a pledge. None has been made - only a steady stream (you hope) of payments. Therefore, you will simply record an outright gift as the cash comes in.

    You will need to ask the publisher about the donor status. Ideally, the author is receiving a 1099 for the income generated while you receive the funds.

    Yes, when the money comes in, this is a gift, from the author, not the publisher. You do not need to confirm anything further, you have evidence of an agency relationship, and can receipt the author.  This redirection of royalties is standard practice in the publishing space.
