  • 1.  Is there a gift here? Rally Up calendar fundraiser

    Does anyone have experience with RallyUp?

    We have a team that ran a calendar raffle fundraiser using the RallyUp platform. Since it was a raffle, these are not gifts. However, the check came (minus some hefty fees) from a donor-advised fund, Pledgeling Foundation. They also included a list of "donors."

    Do we need to record this as a gift from Pledgeling? And if so, should it be unrestricted since there was no designation included? We know the initiative was asking for designated funds for the team, but there's nothing in the letter directing the funds. The DAF also said they don't want a receipt or acknowledgment.

    Honestly, my preference is to pass this back to the team to deposit into their non-gift account, but I'd love to hear how others have handled something similar.

    I think you need to review the contract with RallyUp. I have not used them before. But if your University "hired" them to conduct the raffle in your name, then there probably isn't a gift as they would have been acting as your agent.

    But if they were operating independently, while the purchases of the raffle tickets were not gifts, the revenue could be seen as "proceeds to benefit." A gift would go on the DAF record and you could use the "donor" list for sending "thanks for participating" letters.

    As for what to do with the funds, I think you have to go back to whatever contract your group executed to see what was promised. Further, if participants were assured the proceeds would benefit a specific fund, I think you owe it to them to honor that commitment.

    Agree with John, with the minor amendment that the Pledgeling Foundation operates as a payment processor, and that's something your team would have selected instead of Stripe or Paypal when setting up the event. The upshot is, as John says, that they're agents, and there is no gift. The money isn't restricted in a donation sense, but you do have to use it as promised irrespective of the absence of designation language.

    Thank you John and Isaac, you were both very helpful!  We've determined they were acting as an agent and while the funds will go to the designated team, it won't be counted as a gift.
