  • 1.  Individual Pledges w/ Payments Fulfilled by Crowdfunding/Peer-to-Peer Gifts

    Hi all,

    Has anyone come across a situation where a donor has agreed to a pledge, signed a gift agreement, and then tried to fulfill it via payments or gifts being made by other donors than themselves? We would like to create a policy around this for gift acceptance and were wondering if someone has already gone down this path and has something we can piggyback on.

    This is more appropriate, in my opinion, to handle at the gift agreement level. The pledge should define that it's a personal obligation to give, not to give or get.

    I have drafted pledge agreements that can be used to make it clear who is committing to and paying what.

    Gift Officers must have detailed conversations with donors regarding what they can and cannot commit to. I have attached a template that might be useful in navigating those discussions.

    I have also attached the paper I wrote referenced earlier.

    All good points.

     

    I would only add, on a few occasions, I have been engaged with pledge agreements that specify that payments will come from a group of individuals, typically members of a family or business associates/partners.  One person stood surety that they would make up any balance of the pledge that was not otherwise met, allowing us to record the pledge, but the pledge language indicated that any gift from any of the identified parties for the specified purpose in the specified time frame would count toward the pledge (excluding entities not permitted to make payments toward such a pledge, like DAFs and private foundations, of course).

     

    It all seemed to work quite well, and was blessed by Finance.

    Great point, Alan. So long as the pledge is fully guaranteed by the pledging donor, it can be recorded as a promise to give. There might be some gymnastics on the back-end when a contribution is made by someone else, so that the giver gets hard credit, the payment fulfills the pledge, and the pledging donor gets soft credit. But yes, that solution is compliant with the various rules for accounting, CASE, etc.
