    Our V.P. of Advancement gave a sermon at a local church (he's a pastor.) The church gave him an honorarium check. He would like to endorse the check and give it to our university as a gift from the church.  If he endorses the check, doesn't that make him the legal donor and he receives the receipt?  How can that check be processed as a gift from the church?

    It cannot be a gift from the church under these circumstances.

    Ideally, if the church is to be the donor, the check should be returned, and the church then makes a gift directly to you.

    Thank you, John.  That was my thought.  Can you please point me in the right direction for some kind of documentation to present to our V.P.?  I was told our new V.P. Finance said it would be fine.  I'm guessing he said the check could be signed over to us for a donation.  Identifying the legal donor is not something our Finance department is in the habit of doing.  That is our job in Advancement.  Again, I'm going to be looked upon as the naysayer.

    By signing the check over the individual is affirming it is their money. This is basic banking rules.

    I guess your new VP could issues letter indicating the employee was serving as your fiscal agent. But I would want a letter from the church stating they were making a gift to YOU and not paying the individual an honoraium as was first started.
