    One of our alumni organizations had a fundraiser and received cash donations and submitted a check for the donations in the name of the org.  A list was provided with the name and addresses of those who gave the cash gifts and amounts for each.  Who gets the tax credit?

    Is the alumni organization a separate legal entity? If so, they are the donor unless it was previously established that they would act as your agent.

    If they are a department within your University and a bonded University employee received the cash, then the individuals can be considered donors.

    I should have mentioned that in many public universities, the Alumni Association is set up as a 501(c)(3) Supporting Organization of the University. In these cases, a gift to the Alumni Association is essentially a gift to the University-as long as it meets IRS criteria. Therefore, the AA can accept donations from individuals and pass them on to the University for processing.

    However, as you mentioned, "one of our alumni organizations," I concluded that this might have been an unsanctioned activity carried out by a group of volunteers. If so, that could raise some legal gift acceptance issues often covered in a Third-Party Fundraising Policy.

    If you have more details about the organization and its activities, I and others can offer more insights.
