    I don't see this discussed previously so posing the question to see how others are handling:

     

    We received funds from Global Online Giving Organization via their relationship with Benevity (see link below). The originator of the funds is intending a sponsorship with Benefits. However, the last legal entity is GOGO. We aren't providing benefits to GOGO so nothing to record for the receipt. However, the description of how GOGO can be used indicates it can be used for sponsorships or activities that aren't completely charitable. How are others treating this? In some ways it walks and quacks like a DAF but no DAF that I have seen uses that kind of language about how the funders can direct funds.

    Interested in anyone's experience with this.

    GOGO is incorporated under Canadian Law under the Canada Not-for-Profit Corporations Act. Therefore, it's not a DAF under US Law. However, if they use Benevity (American Online Giving Foundation) to distribute donations in the US, that is a DAF and is subject to all standard DAF restrictions (even if the original "donor" was GOGO).

    Thank you John. The funds came directly from GOGO. It looks to us like they are using Benevity as SAAS Platform provider as described in the description linked below. So, Benevity isn't actually serving as the DAF in this case – at least as far as we can tell.

    John, I did a bit of digging here, and the short version is that gifts through GOGO are not charitably receipted by anyone to the donor - not Benevity, not a DAF, and not GOGO itself. Instead, this is a vehicle for corporations to make "grants" that have sponsorships associated with them. This seems more like a contractual agreement, with an 'advisory' role for the originator of the funds. This makes sense to me in the context of a corporate donor, and what I saw suggests that this is only available to corporations, but you sounded like you were talking about an individual. 

    I would be more concerned here about UBIT than tax deductions, and more generally, the lack of transparency here by Benevity.
