    Hello,

    At my organization we are considering adding language to our giving level/membership brochures to remind donors that gifts made through DAFs/foundations (gifts where the donor has previously received a tax benefit) are excluded from eligibility totals.

    Let's say donors who give at the $100K level receive free valet parking. Valet parking is $15 each time a car is parked. A donor who makes a $53K gift from a personal checking account, $22K through a DAF, $25K through a family foundation may believe they have reached the $100K requirement; however, DAF/foundation gifts are not eligible for benefits or considered in the giving total. Only $53K of this donor's gifts are eligible for benefits.

    Does your organization include language on your giving levels/membership brochures to reminds donors that some gifts do not qualify for benefits? Might you be willing to share or suggest some language to help resolve this issue?

    I can't speak to brochures, but online, I haven't seen many orgs offer these disclaimers. I advise our clients not to use them, for several reasons:
    • It's not relevant to most folks visiting the site
    • the disclaimer is visual clutter that distracts people from what you want them to pay attention to
    • it's bad news
    • most people don't read the disclaimers anyway
    • even among those who do, many of them think that they're special and the rules won't apply to them
    It's better to include this in your soft-credit acknowledgement, with a sentence like 'As you may know, IRS regulations forbid us from offering any benefits such as tickets, seating, parking, or other membership perks for gifts received from a DAF or private foundation. To receive additional benefits, we invite you to consider upgrading your membership by making a personal contribution.'
