  • 1.  Give Aways/Prizes Question

    Posted 02-06-2025 06:51 AM

Our annual fund office is potentially offering below.  This is always in question about these kinds of things.  Can someone advise please?

    Here's How It Works:
    1. Make a Gift of Any Amount to XXXX College between today and February 14, 2025 (example funds listed below)
Even the smallest gift makes a BIG difference!

    2. Join the Challenge: Gifts will be tracked by class year.

    3. Win Prizes for Your Class: One student from every class year will win a prize, but a student from the class year the gives the most gifts will win the grand prize: a $100 Visa gift card

This is a game of chance. No contribution is tax-deductible or countable. See IRS Publication 526, page 7:

"Costs of raffles, bingo, lottery, etc. You can't deduct as a charitable contribution amounts you pay to buy raffle or lottery tickets or to play bingo or other games of chance."

One way to avoid this issue is to follow the "NPR Rule." You will notice that all of their give-away messages conclude with the statement, "No gifts or pledges are necessary to enter the drawing." If you make it possible - and easy - to enter this contest without having to make a gift, you should be on the right side of the IRS.
