    Hi All,

    I know that we can not issue a gift-in-kind receipt for gifts of services. However, I am receiving pushback from higher-ups. Can someone guide me to the IRS documentation that says a tax acknowledgement receipt can not be issued?

    Outside of a couple of circumstances, there is no obligation to receipt charitable donations. Pub 526 is addressed to the taxpayer, and explains what is and is not deductible:

    4. The value of your time or services

    ---

    Since a gift of service isn't a charitable donation, providing a charitable receipt for such a donation amounts to fraud.

    See IRS Publication 526. As these are not tax-deductible gifts, you cannot issue a receipt for them. Doing so would be creating a fraudulent tax document.

    IRS Publication 1771 is the receipting bible, too. That's where you find the language you can use to legally deductible gifts.
