  • 1.  Gift in Kind - Discount question

    Hope I can explain this gift in kind question correctly... If an individual purchases art supplies from various vendors and then resells them at cost to our institution for artists to use, but provides an "in-kind" discount of 30% off on the supplies, but expects payment for the rest... does that 30% discount count as an in-kind donation that they can be receipted for? All receipts for supplies have been submitted. Thanks for any and all advice.

    Selling to a nonprofit as a discount is called a bargain sale, which is part regular sale and part donation, not unlike a QPQ transaction. The seller should provide a full-price invoice, and then a line item for the reduction, which should be called a charitable contribution or donation. You can then receipt them as you would for a GIK.

    I agree with everything Isaac said. However, I do have one word of caution. The original purchaser likely needs to receive reselling permission from the vendors they purchased from.

    Ah - that could apply in this case, depending on the specifics. Not for resale generally only applies if the buyer has a contract with the seller containing that term, or for things like food, where you can't eg sell cookies individually bc of federal labeling requirements. A retailer can't stop a buyer from doing whatever they want with a purchased item in a normal arms length transaction.
