  • 1.  FedEx lost check, donor wants replacement check to count towards 2024

    Hi,

    A donor sent a check via FedEx in mid-December 2024. The package never made it to us (per the package tracking). The donor is sending another check in February of 2025 and wants to know if it can count towards his 2024 charitable giving for tax purchases. What is the correct answer here?

    No. I've attached my annual date of gift reminder document. When it comes to third parties like FedEx, the legal date of the gift (for a donor to determine) is when you receive the package. You cannot be responsible for a loss in the mail.

    While the IRS does accept Fedex express services as qualifying for the mailbox rule as regards IRS filings, this does not apply more generally to charitable donations or any other business purposes. Ultimately, though, this is a question for the donor's tax adviser.

    We dealt with this recently as well-check was sent December 20 and arrived January 12.  We suggested the donor check with her tax advisor and told her we would keep the email thread that started in December. 

     

    A tough one-in our donor's case it was a $250,000 check...And yes-we suggested electronic transfer.  We have a handful of donors who won't consider electronic payments. Perhaps that will change next year πŸ˜‰
