  • 1.  COI Review Request: Professor Donation to Self-Supervised Project

    Hello. Looking for some insight regarding a professor who wants to donate money to fund a student employment research project that he would then supervise.

    The professor would donate to a general student employment account not overseen by him. The funds would then be transferred to his department fund, which is overseen by him. He would not receive any additional stipend or payment for serving as supervisor on this project; however, as supervisor, he would be directly responsible for selecting the students. Are there any self-dealing or other conflict-of-interest concerns we should be aware of?

    The primary conflict would exist only if the students he selected were being paid. Provided they are not and the resulting research products are owned by the University, this arrangement should be acceptable.

    Here's language I often incorporate into a Gift Acceptance Policy that addresses this topic:

    1.      Gifts from University Faculty and Staff

     

    1.1  Gifts from faculty and staff of Cal Lutheran must meet the following three criteria in order to be deductible for tax purposes:

     

    1.2  Charitable intent should be the primary reason for making the contribution.

     

    1.3  The contribution must be credited to a fund not under the sole control of, or that does not personally financially benefit the donating faculty or staff member.

     

    1.4  The faculty or staff donor should not receive or expect to receive future remuneration from the fund to which their gift was credited.  Nor may any individual benefit financially as a result of the contribution per IRS Publication 526.

    The students will be paid, but not the faculty member.
