Charitable Disclosure Statement

    Hello, 

    I wanted to inquire if any other teams had charitable disclosure statements listed in their physical solicitations or listed in their organization's webpages? My team is looking to see if there are any best practices on getting these state disclosure statements set up? We have seen templates of set language to use but wanted to know more this process from other colleagues. Thank you.

    Given the strict language requirements (and length), I have only seen disclosures on websites used effectively.  I have shared many examples previously. Google site:.edu Charitable Solicitation Disclosure for several more examples.

    We use a third party to file all our state fundraising forms, and as part of the service they provide us with a button to link to a seal of compliance. Of course, it's branded to promote their service, but it covers what we need for the online site. We are going to add language to our direct mail to direct people to the website.

    Jackie, your link is precisely what I advocate! It is important to include that URL on all your direct mail pieces, as the language on the right side of your page should be printed on any solicitation. A donor cannot click on a button on a piece of mail! So, we should reference the URL prominently to address (as best we can) state-mandated direct mail requirements.

    NC State uses (or used when I was there) Perlman & Perlman. I also liked Labyrinth when I was searching. Harbor Compliance is another one.

    John, as I understand it, having compliance language on your website and referencing it in your direct mail is not actually compliant with the relevant state regulations. Is that correct? These regulations do seem to be observed mainly in the breach.

    That is correct and is what I mentioned at the beginning of this discussion yesterday after the original post. I am not aware of any organization who includes the required language in the specified font and size required by these states. But it is better than doing nothing.

    Of course, any deviation from a state requirement must be approved by your Counsel - even if the solution is recommended and provided by your state registration vendor.

    Thanks John, this matches my experience. I've only worked with one client who was compliant on DM - they were a very large national advocacy organization with some specific reasons to be concerned about being targeted for compliance actions.

    They used something similar to, or perhaps even identical to, the Perlman disclosure, which has language for each of the relevant states and included it in everything. It was not actually cumbersome, it was just one more piece of paper for the mailhouse to print and stuff.
