    Hello,

    We're currently running a small capital campaign to renovate parts of our Track and Field facilities. The campaign has been doing well to the point where we are likely to meet our goal before the planned public push scheduled for later this year. We still want to do the public push to give people a chance to support the initiative as well as offer some naming opportunities that are still available (and have extra in case of any overages). The way this is set up with finance is that we have a specific fund for the campaign with all the gifts going into this fund. If we have substantial funds left over once the project is complete can the funds be used for general track and field teams operating needs or do the funds have to sit there in perpetuity since the donor's intent was to support a specific capital improvement?

    The funds must be used as solicited and receipted (Article X of the Donor Bill of Rights). However, you can (and should) send a note to all donors now, letting them know about your plans and allowing them to opt out.

    Thanks, just to clarify the opt-out - as in send them a note stating that if they opt-out their gift will only be used for the capital project but if they don't opt-out we are free to use it for related means (track and field related programs)? 

    We don't really have a plan at this point which is why I'm asking here. Would it be better to just cancel the public push (why solicit for funds we don't need and won't use was my initial thought when this was brought up)? Or just advertise during the public push that we've met the goal for the capital project, but they can still support the initiative in spirt with a gift to the track and field program of their choice and they could still qualify for a naming opportunity with a substantial gift to one of the programs?

    You have a couple of options on the opt-out. Your way is fine. You could also say something like, "Our campaign has been tremendously successful thanks to you and all of our donors! If we find we have an excess of project funds, we plan to use those to . . . . Please let us know if you have any questions."

    If you hit your target during the private campaign, why even bother with a public one and then have to jiggle money around? After all, the "public" shouldn't know about the campaign at all, since it hasn't been, well, public.

    Instead, I'd reframe the next phase. I'd announce an overwhelming success with a "limited" campaign to renovate your track and field facilities, and exceeded that goal. Now you are ready to put the cherry on top by launching phase two and raising $X by MM/YY to support the ongoing operating costs of the improved facilities.

    And go ahead and mention a naming opportunity or two if you can make them more operational in nature, such as The John Taylor Track Maintenance Fund - with a plaque and everything!

    To add, we do a negative confirmation opt-out. "If we don't hear from you (30 days from today), we will..."  No response is agreement.
