    Hello, We are grappling with two gift in-kind scenarios that I am hoping to get some advice on. 1. An alumna asked us to organize a celebration of life on campus for her deceased alumna friend. She is paying for the catering and flowers. Her prospect manager has suggested that the university pay for the event and that we record the reimbursement from the alumna as a gift in-kind. Can this be considered a gift in kind (or a gift at all)? 2. Our contract with university's catering company contains a section that says "[Catering company] shall gift (credit) $50,000 in food sales to the President's office for catering events in lieu of Client Maintaining the Premises: restrooms, floors, quarterly vent cleaning, and semi-annual sealing of floors." Advancement has not recorded this as a gift in the past, and our new CFO is asking why. Should this be recorded as a gift? If so, do we need to parse out which portion of the $50,000 credit was used for actual food and beverage and which portion was used for catering services like waitstaff, etc.?     1. Unless you do this for all of your deceased graduates I do not see how this would be mission-related. So I see no gift here at all however you orchestrate it. 2. This is not a gift as it is a contractual requirement. CASE talks about these as corporate partnerships along the lines of affinity credit cards, food service arrangements, exclusive pouring rights, etc. You would not receive this credit if you didn't sign a contract with the company.
