This is not a gift at many levels. Not at the top of the list it benefits specific students. It is not like a scholarship that anyone could apply for with an independent committee selecting the recipients. You could also argue that this is not a gift to the organization. It is a pass-through to those students. I think I already know the answer to this, but wanted to reach out to get other opinions as well. Is it okay for her to do this and us give her a tax deductible receipt for the donation? Basically, she would send us the donation and then the we would pay for the exams directly. The students would never actually receive any funds, just the free exam. To me, this is like any other program specific scholarship donation (but for exams)… am I overthinking this? > > Thanks!!! > > Katlyn Porter > Assistant Director of Advancement Services > Zane State College Foundation > 740.588.1374 > <image003.jpg> >

You will need to ask Counsel. I am thinking not because it is limited to just one class. If open to all students regardless of instructor that would probably work better. But do ask your lawyer. In this case it may still be program specific, but not all students in that program would automatically be eligible to receive the funds and it could be a blind selection by the committee based on who meets the set of requirements. > > Thanks again, > Katlyn > > > From: Advancement Services Discussion List <FUNDSVCS@LISTSERV.FUNDSVCS.ORG> On Behalf Of John Taylor > Sent: Wednesday, August 14, 2019 3:59 PM > To: FUNDSVCS@LISTSERV.FUNDSVCS.ORG > Subject: Re: Faculty Donations > > This is not a gift at many levels. This isn't a gift, and it's probably not great governance either. It's not a gift because it's benefiting a known, small group of beneficiaries. And it's not good governance because it's allowing a faculty member to direct the allocation of charitable resources outside the normal budgeting process and the normal process for acceptance of restricted gifts. Good afternoon - I have a faculty member who would like to donate funds to pay for exam fees for every student in her program. Thank you, John for confirming that I was not overthinking the situation… As a response, because I know this will be the next question, if a set of eligibility requirements are put together (GPA requirement, Program of study, full/part time, etc..) and applications are required in order to receive the funds for the exam, would that change the outcome? In this case it may still be program specific, but not all students in that program would automatically be eligible to receive the funds and it could be a blind selection by the committee based on who meets the set of requirements.
