  • 1.  Question about checks being endorsed over to the Foundation

Whether the checks can be endorsed over is a question you need to ask your bank (and she, hers). Many financial institutions have begun to refuse two-party endorsements. Assuming this is acceptable (rather than returning the checks and asking for ones payable to you), if you have a written statement from the individual stating what you have declared, I would record the gifts on a "Various Donors" record and not issue any receipts. I just had a woman (Patricia) call me and she shared the following: Her daughter-in-law (Jennifer) recently passed away and she has received a number of checks made payable to her (Patricia) that are intended as donations to the hospital. She asked if she could endorse them over to us as opposed to depositing them in her own account and writing a new check to us. I have surprisingly not encountered this scenario before and was wondering how others have handled it. Also, I would treat Patricia as the donor and acknowledge/receipt her, since she is the one determining (ultimately) that the checks made payable to her are to be used as a donation, correct? Thanks! Tacking on to this past conversation with a similar situation with endorsing a check. Our bookstore sold a number of books, then cut a check to the author for a portion of the profits (which had been the agreed-upon arrangement). The author then endorsed our check and sent it back to us, instructing us to direct the proceeds as a donation to needs at the college. Is there any different response in this scenario, given that this would have been income to the person who has now become the donor? Are we able to honor her request (assuming our bank will honor the check?)?
