You could develop some sort of legal relationship with the contractor to have them serve as your agent for the receipt of YOUR money from the donor. I would, however, insist that it is your institution to actually executes a work contract with the contractor following whatever bid process you require. And the contractor or the donor will need to provide you with the proof of payment. And I would insist that the institution approve any/all invoices befor allowing payment. You will want to involve your attorney to work out the legal agent details. John John H. Taylor Principal, John H. If the contractor is acting as YOUR legal agent - as determined by your attorney - then you would issue a standard gift (cash) receipt. But it would have to be to the true legal entity who paid the bill -0 which is why you need a copy of the canceled check or credit card statement. John John H. Taylor Principal, John H. You will have to ask your lawyer. It means that you are authorizing some other entity to act as though they were you for executing a legal transaction - such as accepting a charitable donation. Dear Colleagues, One of our donors has agreed to renovate our old campus. We chose that he pays the contractor directly. The donor wants us to receipt him. Is it possible to add a $amount to the receipt? Or should the receipt only reflect a description of the renovation done? Thank you for your help Regards Farida Farida Ahmed Director, Gift Administration The American University in Cairo Tel: 2615-2481

Thank you John for your reply, Our legal office has already signed an agreement with the contractor, stating that the donor is responsible for the cost of renovation. The agreement includes the phases of renovation and schedule of payments for each phase. The donor shares with us the bank transfer sent to the contractor indicating the amount and related phase. So do you mean that this should not be recorded as a gift in kind? if not then what type of gift is it? Just one more question..Could you please explain more what do you mean by OUR LEGAL AGENT. If we have an agreement signed with the Contractor stating all details of the renovation and the amounts to be paid by the donor, would that make them our Legal agent?
