  • 1.  Scholarships offered for students attending an admissions event

    Hello,

     

    Our Marketing & Admissions team wants to offer a scholarship to a certain subset of potential students (under 150) where the criteria is: if the students come to campus for an admissions event and put a deposit down by the deadline for enrollment, they will receive a set scholarship amount for four years (renewable).  If we were to use gift funds to fund these scholarships, our concern is this seems to come close to the issues around charitable class, but not as directly as some other situations. We are looking for feedback from this group on whether anyone has done this before and/or if there are issues folks see with using gift funds for this purpose.

    I've never seen this done before. I'm also confused by the rules.

    Are you saying that you will predetermine the pool and offer a " discount " to 100% of those who attend?" Or are you saying that anyone who attends the event will receive a discount?

    If the latter, you probably don't have an issue. If the former, I worry about the selection/invitation process.

    And finally, as this does not sound like a need or merit-based scholarship, I wonder how the IRS might view it.

    But this is well outside my comfort zone. You need Counsel to weigh in on this!
