  • 1.  Language to use when receipting real estate

    We have a donor interested in donating a home to us.  I have never receipted a gift of real estate before and am wondering what that would look like.  I know we'll need to acknowledge the gift on the Form 8283, but I believe we also need to send a tax receipt to the donor.

    If the property is owned by the donor free and clear of a mortgage or other financial encumbrances, does the receipt resemble a standard gift in kind receipt?  

    But what if the property does have a mortgage that we would need to pay off before the property can be transferred?  Is there a receipt format for this?

    I appreciate any samples or advice on this.

    Leave this one to your attorney. However, the receipt should reflect the legal description of the property and a notation that it is encumbered. Your attorney will advise you regarding the specific language to use.
