  • 1.  GIK of equipment in return for purchase

    We have a company who is quoting some free equipment in return of making a purchase. Can this free equipment be counted as a GIK? And if not, where does it state this in CASE and/or IRS 526. I see this as a contract and quid pro quo, but this specific scenario I can't find. I appreciate the feedback.

    It is impossible for CASE to individually describe the thousands of possible giving scenarios.

    What CASE does state is that you cannot count contracts.  Clearly, here you would not receive anything unless you purchase something.  That's not a voluntary donation.  That is a contractual obligation.

    This sort of contractual obligation was addressed in a separate memorandum from CASE back in 2011.  Again, it does not address this specific scenario.  But, if you read page two of the attached - the section on "corporate partnerships" - you will see a few related examples.
