    Good afternoon,

     

    We're anticipating a gift from the German Consulate and I want to confirm how we treat it.  Everything I've read in CASE says that gifts from foreign governments can be counted as charitable provided there's charitable intent and we retain control over the use of the funds, and that since this is expected to be less than $250,000 there's no additional reporting requirement – correct?

    I do not see anything in the CASE standards that states this. In fact, they state the opposite. Please see pages 50 & 51:

    Right, but in section 6.2.6 Government Funds it states: "Funds from government sources may not be counted as charitable support. This includes funding from local municipalities, counties, states, provinces, federal government and sovereign tribal nations in which the institution is domiciled." That reads to be me like it's only the funds from the home government of the organization, no?

    No, it says no government funds can be counted - and it goes on to say that INCLUDES those local funds. CASE was trying to be clear that no government funds are countable - including those from your own backyard.

    Hi Betsy,

    I'll just weigh in on the reporting requirement...

    I would recommend that you find a way to keep track of these types of foreign government donations - you never know if Germany will conduct other business or have additional transactions throughout the duration of the year, which in total would amount to $250K+.

    It might be worth determining what office at your university is responsible for Section 117 reporting to the DOE so you can coordinate to provide appropriate information for reporting every six months.

    Perhaps the initial statement in paragraph 1.1.4 (on page 5) listing key summaries of the new Standards offers the most straightforward language:

    "Clearer guidance that governmental grants, whether from local, state, federal, or sovereign tribal nations, are not counted toward fundraising totals. This includes research grants that may pass through other institutions if the initial source of the funding is a government entity."
