  • 1.  Data for a donation?

    We have a local public health foundation with an open RFI seeking data and analysis about general nursing industry employment and challenges. In exchange for participating, participating organizations will either receive a donation or can direct a donation to a nonprofit organization. They'll be using this information to inform future grant priorities to address nursing shortages, but it's unclear whether this will be publicly available information. Would this be a quid pro quo, or is there enough public good involved that this could be considered a donation?

    It sounds like they are buying the data - an exchange transaction. You would not be receiving a donation without sharing the data.

    This is similar to affinity credit card programs. There is no gift. But nothing stops you from entering into the contract unless the data are sensitive or proprietary.
