  • 1.  Brick & Brick Replica Program

    Posted 03-30-2023 09:24 AM

    Hi all,

I know that bricks purchased through our brick program are fully tax deductible but are the replicas as well?  I thought bricks and replicas were both tax deductible but now I'm questioning it.

    Thank you,

    Tammy

The bricks you speak of remain on your property (I am assuming). What, therefore, is being purchased is a form of recognition only - your name is engraved in a brick that remains a permanent part of the organization.

However, if you are selling replica bricks in the store - something purchasers take home - those have a FMV and are not gifts.

On the other hand, if you are giving replicas away in exchange for a donation and those have the institution name or logo, as long as the minimum donation is $62.50, and the value of the replica is $12.50 or less, then they can be given without impacting the donation amount.

Thank you, John!  We charge $250 for the replica and the cost for us is $80 so it looks we need to account for that.

That's a definite QPQ. Although, for gifts of $4,000+, it would fall under the 2% threshold. But also keep in mind that donors contributing through a DAF or private foundation are ineligible to receive any benefit beyond the token limit of $12.50.
