  • 1.  Benefit Amounts and DAFs

    Posted 07-22-2024 01:15 PM

Our university has several museums on campus that provide memberships, and we are getting an increasing number of questions regarding benefit amounts/QPQs and giving through DAFs. I have read through a lot of the comments on this site, but still want to discuss specifics so I can give them the best answers.

    1. One museum's membership levels start at $59 and move up, but we've been told that all members are invited to 2-3 exhibition openings that cost $50+ per head. In this case, how would they list the benefit amount if it is over the amount paid? It seems like this shouldn't be recorded as a gift at all, which would mean they would not receive a tax receipt.
    2. Since their higher membership levels have benefit amounts that hover around 30% of the total- then the only way someone could give through their DAF, would be to waive all benefits, correct? If the museum says they can't offer the option to waive the benefits, they wouldn't be able to accept the grant?
    3. Is a token different from tangible benefits received at an event with food and drinks, per the IRS? If they are different, does the 2% rule deducting token costs from contributions still apply?
    4. Is disclosure of a benefit amount required before a gift is made; or can disclosure be made after the gift, as a line item of their receipt?

Hey there, Christin - Sounds like there are a lot of moving parts here. I'll take a stab at some of these, but I feel as though there are some missing details to really get a solid idea of the structure.

    1.  I checked out the Science and Natural History Museum membership listing and benefits and - wow. HUUUUGE amounts of benefits associated with ALL of the levels of membership. I can see exactly why you would question if there might be any tax-deductible value at all associated with the various membership levels.
    2. Honestly, it seems to me that 30% is a rather conservative estimate for the value of benefits associated with the higher levels of membership. And, yes, if prospective members want to "pay" for their membership via DAF they would certainly need to waive all associated benefits.
    3. The value of 'token' benefits would still need to be calculated when associated with other benefits for levels of membership; they aren't excused if they are part of larger benefit packages which need to address the cumulative value of all proferred benefits.
    4. If you're going to be ethical stewards, then any and all possible benefits associated with memberships should be disclosed prior to any actual investment on the part of donors and provide an option to waive benefits. You need, of course, to also disclose a description of the benefits (along with a notation of the value thereof) in your receipting process.

Please feel free to contact me off list if you would like to discuss in greater detail; I've worked a few member-driven organizations and would be happy to do some brainstorming with you to sort through this a bit more if you think that might be helpful.

    With best regards,
