  • 1.  Requiring an internship to renew scholarship

    Good afternoon,

    I have a request that I think is not allowed, but want to make sure before I definitely say no. We have a company who would like to make an internship (with their company) a requirement for receiving a scholarship that they establish. We've traditionally separated internships and scholarships, so scholarship recipients are eligible for internships, but they're not directly tied to their scholarship. It's essentially between the student and the company to work out the internship particulars.

    This company's exact request was to create a two year scholarship and require that, in order for the recipient to receive the funding the 2nd year, they complete a summer internship with this company between the two years. I certainly don't see a problem requiring that the student have an internship, the issue for me is that it must be with this company providing the scholarship. Am I off base here in telling them we can't do that?

    It is not allowed.  When I was at NC State we made any sort of subsequent internship or employment a private matter between the donor and recipient.  It cannot be a condition of the scholarship or fellowship.  You can require the recipient to agree to have their contact information shared with the donor.  But beyond that, any employment relationship is strictly between those two private parties.

    Are you saying just don't put that requirement in the gift agreement but allow it to happen? What if after a few years it has happened with all the recipients? Isn't that kinda quid pro quo-ish?

    Not at all.  There is no requirement.  The student has no obligations tied to the scholarship.  They receive the money regardless.  If they wish to enter into an employment contract with the donor at some future date, they can.  But they also can completely ignore any overtures made by the donor.

    University Counsel reviewed and blessed the arrangement indicating there was no QPQ because nothing was promised or implied.
